Regulations of the Online Store www.tactgear.eu

I. General provisions

1) These Regulations specify the general conditions, rules for using the Online Store and the method of providing services by electronic means and sales conducted via the Online Store www.tactgear.eu by SHARG Artur Grzegorczyk with its registered office at ul. Rożnowska 6, 04-213 Warsaw.

2) Contact with the Service Provider takes place through:

a) e-mail address info@tactgear.pl;

b) by phone at +48 22 517 34 92;

c) the application form available at https://tactgear.eu/contact-pol.html

These Regulations are continuously available on the website https://tactgear.eu/, in a way that allows Users to obtain, reproduce and record its content by printing or saving on a carrier at any time.

II. definitions

The terms used in the Regulations mean:

1) Business days - these are days from Monday to Friday, excluding public holidays;

2) Customer - an adult natural person who has full legal capacity, a legal person or an organizational unit which is not a legal person, the special provisions of which grant legal capacity, which places Orders within the Store;

3) Civil Code - the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);

4) Account - a part of the Online Store assigned to a given Customer, by means of which the Customer may perform specific activities within the Online Store;

5) Regulations - this document;

6) Registration - a one-off activity consisting in the Account being created by the Customer
using the registration form provided by the Seller on the Online Store website;

7) Online Store (Store) - websites through which the Customer can
in particular, place Orders;

8) Seller - Artur Grzegorczyk running a business under the name Artur Grzegorczyk Sharg in Warsaw, entered into the Central Register and Information on Economic Activity kept by the Minister of Economy, at ul. Rożnowska 6, 04-213 Warsaw NIP: 1130040820 REGON: 012056847;

9) Goods - products presented in the Online Store, the description of which is available at each
from presented products;

10) Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between the Seller and the Customer;

11) Services - services provided by the Seller to the Customers electronically within the meaning of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);

12) Act on consumer rights - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, No. 827);

13) Act on the provision of electronic services - the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);

14) Order - Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Good.



III. Rules for using the Online Store

1) Using the Online Store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:

a) a computer with Internet access,

b) access to electronic mail,

c) Internet Explorer Internet browser version 11 or newer, Firefox version 28.0 or newer or Chrome version 32 or newer,

d) enabling cookies and Javascript in the web browser.

2) Using the Online Store means any act of the Customer that leads to becoming acquainted with the content contained in the Store.

3) The customer is obliged in particular to:

a) not to provide or transfer content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties,

b) using the Online Store without disturbing its functioning,
in particular by using specific software or devices,

c) not to take actions such as: sending or placing unsolicited commercial information (spam) as part of the Online Store,

d) use the Online Store in a way that is not inconvenient for other customers and for the Seller,

e) use any content posted as part of the Online Store only
in the scope of own personal use,

f) use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.

IV. Services

1) The Seller via the Online Store uses the free Services consisting of:

a) reviewing information posted in the Online Store,

b) keeping an Account in the Online Store,

c) sharing an interactive form enables

d) providing the Newsletter service,

e) providing an interactive form enabling customers to contact the Seller,

f) posting statements about the Goods in the Store.

2) indicated in point 1 Services are provided by the Seller 24 hours a day, 7 days a week.

3) Agreement:

a) for the provision of a service consisting in reviewing information contained in the Store is concluded for a definite period of time and terminates when the Customer closes the Store's website,

b) for the provision of the service of keeping an Account in the Store is concluded for an indefinite period and terminates when the Customer sends a request to delete the Account or use the "Delete Account" button,

c) for the provision of a service consisting in providing an interactive form enabling customers to place an Order in the Store is concluded for a definite period of time and is terminated upon placing the Order,

d) the Newsletter service is concluded for an indefinite period and is terminated when the Customer sends a request to remove his email address from the Newsletter subscription or unsubscribing using the link contained in the content of the message sent as part of the Newsletter service,

e) for the provision of a service consisting in providing an interactive form enabling customers to contact the Seller is concluded for a definite period of time and is terminated as soon as the Seller provides a response,

f) for the provision of a service consisting in posting reviews of Goods in the Store is concluded for a definite period of time and terminates when the opinion is added.

4) The service of maintaining an Account in the Online Store is available after registration. Registration takes place by completing and accepting the registration form provided on one of the Store's pages.

5) The condition of Registration is to agree to the content of the Regulations and provide personal data marked as mandatory.

6) The Customer may receive commercial information from the Seller in the form of messages sent to the e-mail address provided by the Customer (Newsletter service). To do this, enter a valid e-mail address or activate the appropriate field in the registration form or Order form. The Customer may at any time withdraw his consent to send commercial information. The Newsletter is sent by the Seller only to the Customer who subscribed.

7) The Customer has the option of posting individual and subjective statements in the Store regarding to the Good or the course of the transaction. By adding statements, the Customer declares that he has all rights to this content, in particular copyrights, related rights and industrial property rights.

8) In order to post, statements, the Customer may be asked to provide their data, e.g. email address.

9) Statements should be edited in a transparent and understandable manner, and may not contain unlawful content.

10) Statements may not violate applicable law, including the rights of third parties -
in particular, they may not be defamatory, infringe personal rights or constitute an act of unfair competition.

11) The Customer publishes statements in the Store voluntarily. Posted statements are disseminated on the Store's websites.

12) By posting a statement, the Customer agrees to the free use of this statement and its publication by the Seller, as well as the development of works within the meaning of the Act on Copyright and Related Rights (Journal of Laws of 1994 No. 24 item 83).

13) In the event of a breach by the Customer of the provisions of these Regulations, the Seller, after a previous unsuccessful call to cease or remove violations with an appropriate deadline, may terminate the contract for the provision of Services with a 14-day notice period.

14) The Store has the right to organize occasional competitions and promotions, the terms of which will always be provided on the Store's websites.

15) Promotions in the Store cannot be combined, unless the Regulations of a given promotion provide otherwise.

V. Procedure for the conclusion of the Sales Agreement

1) Information about the Goods provided on the Store's websites, in particular their descriptions, technical and functional parameters as well as prices, constitute an invitation to conclude a contract within the meaning of art. 71 of the Civil Code.

2) All Goods available in the Store are brand new, free from physical and legal defects, and have been legally placed on the Polish market.

3) A condition for placing an Order is having an active e-mail account.

4) The condition for placing an Order by telephone is to have an active e-mail account and telephone line.

5) A condition for placing an Order via email is to have an active email account.

17) The Agreement is concluded when the Customer sends (in response to confirmation of the terms of the Order sent by the Seller) an electronic message to the Seller's e-mail address, in which the Customer: accepts the content of the sent Order and agrees to its implementation, and accepts the content of the Regulations and confirms that he has read instructions on withdrawal from the contract.

18) After the conclusion of the sales contract, the Seller confirms the terms of the Customer by sending them to the Customer's e-mail address or in writing to the address provided by the Customer.

19) The sales contract is concluded in Polish, in accordance with the Regulations.

VI. Supply

1) Delivery of Goods takes place to the address provided by the Customer when placing the Order. Deliveries of certain Goods and Orders are carried out to countries where these Goods have been authorized.

2) The Customer may choose the following forms of delivery of the ordered Goods:

a) via courier,

b) via a postal operator,

c) delivered to the Parcel Locker,

d) personal pickup at the personal pickup point of the seller.

3) In addition, delivery costs will be indicated when placing the Order.

4) The Seller on the Store's websites in the description of the Goods informs the Customer about the number of Working Days needed to complete the Order and its delivery.

5) The date of delivery and execution of the order is calculated in Business Days in accordance with point VII point 2.

6) The Seller, in accordance with the will of the Customer, provides the Goods with a receipt or a VAT invoice covering the delivered Goods.

7) The Seller is responsible for defects of things in accordance with the provisions of the Civil Code, in particular art. 556 and 5561 -5565 of the Civil Code.

VII. Prices and payment methods

1) The prices of the Goods are given in Polish zlotys and contain all components, including VAT, customs duties and all other components.

2) The customer can choose the following payment methods

a) bank transfer to the Seller's bank account (in this case, the Order will be processed after the Seller has sent the Customer confirmation of the Order, and the shipment will be made immediately after the funds are credited to the Seller's bank account and the Order is completed);

b) cash on personal pickup - payment at the Seller's personal pickup point (in this case, the Order will be processed immediately after the Seller sends the confirmation of the Order acceptance to the Customer, and the Goods will be released at the Seller's personal pickup point);

c) cash on delivery, payment of the supplier when making the delivery (in this case, the implementation of the Order and its shipment will begin after the Seller sends the Customer confirmation of the acceptance of the Order and completing the Order);

d) electronic payment (in this case, the Order will be initiated after the Seller sends the Customer confirmation of the Order and after the Seller receives information from the paying agent about the payment by the Customer, and the shipment will be made immediately after completing the Order).

3) The Seller on the Store's websites in the description of the Goods informs the Customer about the date in which he is obliged to make payment for the Order. In the absence of payment by the customer within the time limit referred to in the previous sentence, the seller after a previous unsuccessful call to cease or remove violations with an appropriate deadline may withdraw from the sales contract pursuant to art. 491 of the Civil Code.

VII. Prices and payment methods

1) The prices of the Goods are given in Polish zlotys and contain all components, including VAT, customs duties and all other components.

2) The customer can choose the following payment methods

a) bank transfer to the Seller's bank account (in this case, the Order will be processed after the Seller has sent the Customer confirmation of the Order, and the shipment will be made immediately after the funds are credited to the Seller's bank account and the Order is completed);

b) cash on personal pickup - payment at the Seller's personal pickup point (in this case, the Order will be processed immediately after the Seller sends the confirmation of the Order acceptance to the Customer, and the Goods will be released at the Seller's personal pickup point);

c) cash on delivery, payment of the supplier when making the delivery (in this case, the implementation of the Order and its shipment will begin after the Seller sends the Customer confirmation of the acceptance of the Order and completing the Order);

d) electronic payment (in this case, the Order will be initiated after the Seller sends the Customer confirmation of the Order and after the Seller receives information from the paying agent about the payment by the Customer, and the shipment will be made immediately after completing the Order).

3) The Seller on the Store's websites in the description of the Goods informs the Customer about the date in which he is obliged to make payment for the Order. In the absence of payment by the customer within the time limit referred to in the previous sentence, the seller after a previous unsuccessful call to cease or remove violations with an appropriate deadline may withdraw from the sales contract pursuant to art. 491 of the Civil Code.

XII. guarantees

1) Goods may have a manufacturer's, Seller's or importer's warranty.

2) In the case of Goods covered by a guarantee, information regarding the existence and content of the guarantee and the time for which it was granted is always presented in the description of the Good on the Store's websites.

XIII. Out-of-court complaint settlement and redress methods

1) The customer who is a consumer has, among others the following possibilities of using out-of-court complaint and redress methods:

a) is entitled to apply to a permanent amicable consumer court operating at the Trade Inspection with a request to settle the dispute arising from the concluded Sales Agreement.

b) is entitled to request the provincial inspector of Trade Inspection to initiate mediation proceedings regarding the amicable settlement of the dispute between the Customer and the Seller.

c) may obtain free assistance in resolving the dispute between the Customer and the Seller, also using the free assistance of the poviat (municipal) consumer ombudsman or social organization whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers) . Advice is provided by the Consumer Federation under the free consumer helpline number 800 007 707 and by the Association of Polish Consumers at email advisers@dlakonsumentow.pl.

d) may lodge its complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/

XIV. Personal data protection

1) The personal data provided by the Seller is collected and processed by the Seller in accordance with applicable law and in accordance with the Privacy Policy, which is Annex 3 to the Regulations.

XV. Final Provisions

1) Settlement of any disputes arising between the Seller and the Customer who is a consumer within the meaning of art. 22 [1] of the Civil Code, is submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

2) Settlement of any disputes arising between the Seller and the Customer who is not a consumer within the meaning of art. 22 [1] of the Civil Code of the Civil Code, is subject to the court having jurisdiction over the registered office of the Seller.

3) In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services, the provisions of the Act on consumer rights and other relevant provisions of Polish law shall apply.

4) The content of these Regulations may change. Every customer will be notified of any changes through information on the Store's main page containing the list of changes and their date of entry into force. Customers who have a Customer Account will be additionally informed about the changes together with their summary to the e-mail address provided by them. The date of entry into force of the amendments will not be less than 14 days from the date of their announcement. If the Customer having a Customer Account does not accept the new content of the Regulations, he shall be obliged to notify the Seller of this fact within 14 days from the date of notification of the change in the Regulations. Lack of acceptance results in termination of the contract.
